E-bike Test Ride | Release Clause

 

The applicant acknowledges, declares and agrees that

 

  • he/she is over 18 years of age and wish to try the e-bike of the company O.Z. SpA ("OZ") during the event hosted in the Salone del Camper di Parma 2024 (PR) on the test ride date  (the "Activity");

  • understand that the use of e-bikes involves certain risks and hazards, such as collisions, falls, injuries, malfunctions, loss or damage of property, and that he/she voluntarily assumes all such risks and hazards for himself/herself and his/her personal belongings;

  • is in good physical and mental health and have no medical conditions or impairments that may affect his/her ability to use the e-bike safely and responsibly. He/She is not under the influence of alcohol, drugs or any other substances that may impair his/her judgment or coordination;

  • release and exempt OZ, its affiliates, directors, officers, employees, agents, contractors, sponsors, partners, and the event organizers, from any and all liability whatsoever for any harm, injury, death, loss or damage that he/she may suffer or cause as a result of his/her use of the e-bike or his/her participation in the Activity, whether caused by negligence, breach of contract, or otherwise, and whether suffered by him/her or by any third party;

  • will indemnify and hold harmless OZ, its affiliates, directors, officers, employees, agents, contractors, sponsors, partners, and the Event organizers, from and against any and all claims, demands, actions, liabilities, damages, costs and expenses, arising out of or in connection with him/her use of the e-bike or his/her participation in the Activity, whether caused by negligence, breach of contract, or otherwise, and whether suffered him/her me or by any third party;

  • to respect and protect the E-bikes and to return the E-bikes in the same condition as him/her received them. He/She agrees to pay for any damages, repairs, or replacements that may be necessary due to him/her misuse, abuse, negligence, or vandalism of the E-bikes;

  • this release form is governed by and construed in accordance with the laws of Italy, and that any dispute arising out of or in relation to this release form or him/her participation in the Activity or his/her use of the E-bikes shall be submitted to the exclusive jurisdiction of the competent court of Vicenza, Italy

He/She confirms that he/she has read and understood this release form before signing it and he/she is fully aware that by signing the same he/she waive any action against OZ for damages of any kind suffered as a result of his/her participation in the Activity, to the fully extent permitted by the law.

Il richiedente dichiara

 

  • Di avere compiuto 18 anni e di volere utilizzare la e-bike della società O.Z. S.p.A. ("OZ") durante l'evento "Salone del Camper" in data odierna (l'"Attività");

  • Di essere consapevole che l'utilizzo delle e-bike comporta vari rischi e pericoli, tra cui collisioni, cadute, lesioni, malfunzionamenti, nonché perdita o danneggiamento di beni, e di assumersi integralmente ogni responsabilità in relazione a tali rischi e pericoli, sia per la propria persona che per i propri effetti personali;

  • Di godere di buona salute e di non aver mai sofferto anche occasionalmente di patologie e/o imperfezioni fisiche tali da rendere pericolosa o dannosa per la salute la partecipazione all’Attività, in modo sicuro e responsabile. Di non essere sotto l'effetto di alcol, droghe o altre sostanze che possano compromettere la propria capacità di giudizio o di coordinazione;

  • Di sollevare OZ, le società controllate, i suoi direttori, funzionari, dipendenti, agenti, appaltatori, sponsor, partner e gli organizzatori dell'evento da qualsiasi responsabilità per qualsiasi danno, lesione, morte, perdita o danno subiti dal sottoscritto o causati a terzi in conseguenza della partecipazione all'Attività, dovuti da negligenza, violazione delle regole o altro;

  • Di manlevare OZ, le società controllate, i suoi direttori, funzionari, dipendenti, agenti, appaltatori, sponsor, partner e gli organizzatori nei confronti di ogni pretesa, azione, responsabilità, danno, costi e spese, derivanti da o in relazione alla partecipazione all'Attività, siano essi causati da negligenza, violazione delle regole o altro, e siano essi subiti dal sottoscritto o da terzi;

  • Di accettare di custodire e conservare le e-bike e di restituirle nelle stesse condizioni in cui sono state consegnate. Di impegnarsi a pagare eventuali danni, riparazioni o sostituzioni che potrebbero essere necessari a causa di un uso improprio, di un trattamento errato o di negligenza da parte del sottoscritto;

  • Di accettare che il presente modulo di liberatoria sia disciplinato e interpretato in conformità alla normativa vigente in Italia, e che ogni controversia derivante o connessa al presente modulo, alla partecipazione all'Attività o all'utilizzo delle e-bike, sia devoluta alla competenza esclusiva del tribunale territorialmente competente di Vicenza.

Il richiedente conferma di aver letto e compreso integralmente il presente modulo di liberatoria prima della sua sottoscrizione e di essere pienamente consapevole di rinunciare, con la firma dello stesso, a ogni azione nei confronti di OZ per eventuali danni di qualsiasi natura subiti in conseguenza della partecipazione all'Attività, nella misura massima consentita dalla legge.
